Final decision is based primarily on the fact that alachlor is a highly hazardous pesticide based on the WHO classification. It poses an unacceptably high risk to human health and the environment. The pesticides and Toxic Chemicals Control Board is committed to registering only lowest risk pesticides for use in the country unless viable alternatives are unavailable. Viable alternatives are available for this product.

Decree No. 5769/1959, that determines the establishment of the National Phitosanitary Register under the General Directorate of Plant Health of the Secretary of State for Agriculture and Livestock, where any person involved on sales within the territory of the Argentine Republic must be registered (as essential requisite), either to commercialise by their own or on behalf of others or representing, if imported products, chemical or biological products, intended for the treatment or destruction of animal or plant enemies of cultivated plants, as well as adjuvants of such products and substances of hormonal activity for pest control. To date, the chemical Alachlor is registered in the National Phitosanitary Register.

The import and use of Alachlor, in all its forms, are banned in Burundi by Ministerial Ordinance nº 710/1464 of 16 October 2013.

The causes of its ban are the following: i) carcinogenic to animals and potentially carcinogenic to human beings (class/category 3. R340 being suspected to be the cause of tumours of the nasal cavities in rats); ii) its behaviour in the environment is cause of concern especially for the formation of a great variety of degradation products, some of which are of toxicological and/or eco-toxicological concern

Alachlor is recorded in the register of banned pesticides under nº 2013-01-P-001.

Remarks:

The herbicide Alachlor has never been imported, sold, stocked or used in agriculture in Burundi

In line with the information from the Technical Department of Agricultural Inputs Safety of ICA, the Alachlor holds sales record No.1346 of 25th June 1991, and No.434 of January 2001. Authorised uses are as herbicide to control weeds (arvensis) in: soybean, sorghum, cotton, peanuts, sesame, maize and cassava.

In line with the Andean Decision of Nations No.436; Andean Standard for the Registration and Control of Chemical Pesticides for Agricultural use, published in Official Journal (Year XIV, No.347, in Lima, Peru, on 17th June 1988, on the Cartagena Agreement), and the Resolution of the Colombian Institute for Agriculture and Farming (ICA) No.03759 of 16th December 2003, to enact provisions for the Registration and Control of Chemical Pesticides for Agricultural use, pesticides must be registered to be used and marketed in the country.

IMPORTANT NOTE: According to information from the Technical Department of Agricultural Inputs Safety of ICA, the product holds sales Register No.1346 of 25th June 1991, and 434 of 29th January 2001, and consequently it can be imported in Colombia as herbicide to control weeds (arvensis) in: soybean, sorghum, cotton, peanuts, sesame, maize and cassava. Only the company owning the mentioned register may import the product.

Remarks:

Decree No. 2820 of 2010, published in the Official Journal No. 47792 of 5th August 2010, Title II, on the exigibility of Environmental Licenses, in Article 8, established that the Ministry of Environment, Housing and Territorial Development, may permanently grant or deny such environmental license for the activities (…)11. The import and/or manufacturing of those substances, materials or products subject to controls pursuant to treaties, conventions and international protocols, of environmental nature, except in cases where these rules point out a special authorisation for such purpose. Decree No. 38677-MAG-S-MINAE-MTSS established:

Article 1 - The purpose of this Decree is to prohibit the registration, import, export,

manufacturing, formulation, storage, distribution, transportation, repackaging, handling, sale, mixing and use of the technical grade active ingredient and synthetic pesticides formulations containing the active ingredient alachlor.

Article 2 - The Ministries of Agriculture and Livestock; Health; Environment and Energy; and

Labor and Social Security complying with their Laws and competencies, will ensure the compliance of these provisions.

Article 3 - Failure to comply with the provisions established in this Decree will timply the application of the sanctions that the General Law of Health, the Organic Law of the Environment, the Phytosanitary Protection Law and the Labor Code, without prejudice to the rest of sanctions established in the national legislation.

Sole transitory: Individuals or legal entities that register, import, export, manufacture, formulate, store, distribute, transport, repackage, handle, sell, mix and use technical grade active ingredient or synthetic pesticides formulations containing Alachlor, will have a non-renewable term of six months, from the publication date of this Decree in the Official Gazette, to run down their stocks in the domestic market. After this period, the Ministry of Agriculture and Livestock through the State Phytosanitary Service will proceed to cancel all these registrations.

For a final decision to be taken, decisions must be adopted at national level. It is prohibited to place on the market or use plant protection products containing alachlor, since this active substance is not approved under Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC (OJ L 309, 24.11.2009, p. 1), pursuant to Commission Decision 2006/966/EC of 18 December 2006 concerning the non-inclusion of alachlor in Annex I to Council Directive 91/414/EEC and the withdrawal of authorisations for plant protection products containing this active substance (OJ L 397, 30.12.2006, p. 28).

Remarks:

Pursuant to Pest Control Products Act CAP 346 and the Pest Control Products (Registration) Regulations of 1984 (Rev.2012) on safeguarding human health and environment, the Board of Management of the Pest Control Products Board banned the use of Alachlor in 2011. The final decision of no consent to import was made through PCP Act CAP 346 and the Pest Control Products (Registration) Regulations of 1984 (Rev.2012), which empowers the Board to refuse approval of use of a pest control product if the use of the pest control product would lead to an unacceptable risk to public health, plants, animals, or the environment. The legal provisions allow the Board to revoke any existing registration if new information becomes available that renders the pest control product unsafe or dangerous.

The final decision was informed by the decision guidance document (DGD) on Alachlor that was communicated to designated national authorities on 24th October 2011, and by supporting information from notifying countries of EU and Canada.

From the information sources of two long-term dietary studies in rat and a long-term mouse study, it was concluded that alachlor was deemed an animal carcinogen with potential as a human carcinogen. The presence of alachlor in ground water with further potential of contamination increased the concerns around the molecule. This resulted to the conclusion that alachlor presents unacceptable risk of harm to public health.
