They pose an unacceptably high risk to human health and the environment. The
pesticides and Toxic Chemicals Control Board is committed to registering only
lowest risk pesticides for use in the country unless viable alternatives are
unavailable. Viable alternatives are available for this product.

In line with the Andean Decision of Nations No.436; Andean Standard for the Registration and Control of Chemical Pesticides for Agricultural use, published in Official Journal (Year XIV, No.347, in Lima, Peru, on 17th June 1988, on the Cartagena Agreement), and the Resolution of the Colombian Institute for Agriculture and Farming (ICA) No.03759 of 16th December 2003, to enact provisions for the Registration and Control of Chemical Pesticides for Agricultural use, pesticides must be registered to be used and marketed in the country.
IMPORTANT NOTE: According to information from the Technical Department of Agricultural Inputs Safety of ICA, dustable powder formulations are not registered for domestic sales in the Colombian Institute for Agriculture and Farming (ICA), and consequently can't be imported, manufactured, formulated, distributed, marketed or used in Colombia.
Remarks:
Decree No. 2820 of 2010, published in the Official Journal No. 47792 of 5th August 2010, Title II, on the exigibility of Environmental Licenses, in Article 8, established that the Ministry of Environment, Housing and Territorial Development, may permanently grant or deny such environmental license for the activities ()11. The import and/or manufacturing of those substances, materials or products subject to controls pursuant to treaties, conventions and international protocols, of environmental nature, except in cases where these rules point out a special authorisation for such purpose. Since they are LMO's (Living Modified Organisms), for which only the procedure established in Act 740 of 2002 and its regulatory decrees or rules that modify, replace or repeal it will be applied in their evaluation and decision.

Conditions for import:
Each of these products (benomyl, carbofuran and thiram) is registered for the treatment of either pineapple, maize, bananas or oil palm. However, the association of these three pesticides is not registered.
In this context, the import of each product (benomyl, carbofuran, thiram) is allowed for the above- mentioned treatments.
Remarks:
For a final decision to be taken, decisions must be adopted at national level. This is why, for an effective implementation of the Rotterdam Convention, we have worked out a draft decree on the implementation of the above Convention. We shall be able to finalize all import responses as soon as the decree is signed.

It is prohibited to use or place on the market all plant protection products containing benomyl. Benomyl was excluded from Annex I to Council Directive 91/414/EEC and thus authorisations for plant protection products containing this active substance had to be withdrawn (Commission Decision 2002/928/EC of 26 November 2002, OJ L 322, 27.11.2002, p.53).
It is prohibited to use or place on the market all biocidal products containing benomyl. In accordance with Commission Regulation (EC) No 1451/2007 of 4 December 2007 on the second phase of the 10-year work programme referred to in Article 16(2) of Directive 98/8/EC of the European Parliament and of the Council concerning the placing of biocidal products on the market the chemical is not allowed to be placed on the market for use as a biocidal product and had therefore to be withdrawn from the market as from 1 September 2006.

The Pesticides Technical and Advisory Committee in Sri Lanka has decided at its 56th meeting, held on the 7th October 2011, not to allow manufacture, registration and importation of dustable powder formulations containing a combination of benomyl at or above 7%, carbofuran at or above 10% and thiram at or above 15% with immediate effect.

Article (14) The Ministry, in coordination with the specialized agencies shall designate the environmental conditions for the import, distribution, manufacturing, use, and store of pesticides, substances, and agri-chemical fertilizers, which may pose hazards to the environment.
Article (15) The Ministry, in coordination with specialized agencies, shall set instructions and standards specified for agri-chemicals, that are allowed to be imported, manufactured and distributed in Palestine, and shall ensure observance of it.
2.Palestinian agricultural law No. 2 of 2003 give responsibilities to the Ministry of Agricultural to establish national scientific committee to register pesticides and specify technical specification and information related to pesticides.
3.Agricultural pesticides bylaw No. 9 for the year 2012
Article (4) It is prohibited to register any pesticide of the following pesticides: 1. Banned pesticides in Palestine. 2. Banned Pesticides in the origin country for health or environmental reasons. 3. Pesticides classified by the World Health Organization and the US Environmental Protection Agency as containing chemicals that cause cancerous tumors, congenital malformations, genetic mutations or highly toxic to humans or animals. 4. Pesticides that cause contamination of groundwater.
4.The national scientific committee of agricultural pesticides adopt the national guide list of agricultural pesticides allowed to be used in state of Palestine.
5.The National Technical Committee for the Management of Chemicals and Hazardous Waste reviewed the chemicals have been listed in Annex III of the Rotterdam Convention and Stockholm convention and adopted import response.

Legislative or administrative measures:
According to the Law on Veterinary Services, Plant Health, Food and Feed Law no. 5996 dated 11/06/2010 and the By-law On Licensing/Registration Marketing of Plant Protection Products (Official Gazette no. 30235 dated 09.11.2017), marketing (including import) and use of unregistered plant protection products within the territory of the country are prohibited. In the world chemicals market the mixtures of Benomyl, Carbofuran and Thiram have been used as biocidal product. According to the By-law on Biocidal Products (Official Gazette no. 27449 dated 31.12.2019), marketing (including import) and use of unregistered biocidal products within territory of the country are also prohibited. The mixtures of Benomyl. Carbofuran and Thiram are not registered as plant protection product or biocidal product in the country therefore the final decision of Turkey is no consent to import.
Remarks:
Benomyl is listed as Mutagenic-Category-1A and Toxic to Reproduction System-Category-1B in the By-law on Regitrtion, Evaluation, Authorization and Restriction of Chemicals )(Official Gazette no 30105 dated 23.06.2017).
