Executive Decree No 38713-MAG-S-MINAE-MTSS, prohibits the registration, import, export, manufacture, formulation, storage, distribution, repackaging, handling, sale, mixing, transportation, repacking, technical grade ingredients and pesticides containing Carbofuran.
Points 3, 5 and 6 of the Decree describe why the action was taken, as indicated below:
3- The pesticide insecticide and nematicide of chemical group carbamate and active ingredient carbofuran, chemical name IUPAC: 2,3-dihydro-2,2-dimethyl-7-benzofuranyl-N-methylcarbamate and CAS: 2, 3-dihydro-2,2-dimethyl-7-benzofuranyl methylcarbamate, CAS Number 1563-66-2, due to its high toxicity, represents a potential risk to exposed workers and to consumers of vegetables where pesticide has been applied.
5- Agreement number IX of the XXIII Meeting of Ministers of Health of Central America and the Dominican Republic (RESSCAD), hold in the Republic of Honduras in 2000, provides for the application of more effective legal controls aimed at the prohibition and restriction of chemical pesticides that cause greater morbidity/mortality in the Central American area.
6- Executive Decree No 34149-S-MAG-TSS-MINAE aims to regulate registration, importation, re-destination, manufacturing, formulation, repacking, storage, sale, mixing, commercialization and use, of raw material or formulated product, of products containing agricultural pesticide Carbofuran, but its application has been insufficient to eliminate or minimize the occupational risk associated with its use"

In the Union, it is prohibited to place on the market or use plant protection products containing carbofuran, since that active substance has not been approved under Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC (OJL 309, 24.11.2009, p.1).
Furthermore, it is prohibited to make available on the market or use biological products containing carbofuran, since that active substance has not been approved pursuant to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (OJ L167, 27.6.2012, p.1).

Currently pesticides containing Carbofuran are not registered in Japan. If the chemical mixture is intended to be sold and/or used as plant protection product in Japan, it must be registration of the chemical is needed before Import.

Legislative or administrative measures:
Pursuant to Pest Control Products Act CAP 346 and the Pest Control Products (Registration) Regulations of 1984 (Rev.2012) on safeguarding human health and environment, the 143rd Board of Management of Pest Control Products Board banned the use of Carbofuran on 14th March 2019. The PCP Act CAP 346 and the Pest Control Products (Registration) Regulations of 1984 (Rev.2012) empowers the Board to refuse approval of use of a pest control product if the use of the pest control product would lead to an unacceptable risk to public health, plants, animals, or the environment. The Board may also revoke any existing registration if new information becomes available that renders the pest control product unsafe or dangerous.
The final decision was informed by the guidance document (DGD) on Carbofuran that was communicated to designated national authorities on 15th September 2017 in accordance with Articles 7 and 10 of the Rotterdam Convention, and by supporting information from notifying countries of European Union, Canada and the CILSS countries.
From the information sources, it was concluded that the use of carbofuran presents an unacceptable risk to human health and the environment. In human health consideration, carbofuran was observed to present unacceptable occupational risk of harm to operators and workers conducting certain mixing, loading, applying or post-application activities. Dietary risk assessment demonstrated that exposure to carbofuran from food and drinking water was unacceptable.
Carbofuran also posed unacceptable risk to terrestrial and aquatic organisms. Additionally, thirty-three environmental incident reports from the United States and Canada were considered during the review of carbofuran and indicated that exposure to carbofuran under the registered use pattern resulted in avian, small wild mammal and bee mortality.

Within the meaning of this Title, a registration shall be the act whereby the Ministry of agriculture approves the placing on the market and the use of a plant protection product following the evaluation of comprehensive scientific data demonstrating that the product is effective for the purposes intended and not unduly hazardous to human and animal health or the environment.

On 27 June 2013, the Environmental Protection Authority of New Zealand under the Hazardous Substances and New Organisms Act 1996 (HSNO Act) decided that all approvals for the import, manufacture or use of carbofuran were to be revoked. The revocation of approvals followed a reassessment carried out under the provisions of section 63 of the HSNO Act, which included a determination that the environmental and human health risks associated with the use of the products outweighed the benefits obtained from its use.

Under section 25 of the HSNO Act it is prohibited for a hazardous substance to be to be imported or manufactured without an approval under the HSNO Act. As no approvals for carbofuran exist, such substances may not be imported into New Zealand.
Remarks:
Carbofuran is also listed in Schedule 2: Rotterdam chemicals of the Imports and Exports (Restrictions) Prohibition Order (No 2) 2004. It may not be exported unless a permit is issued by the Environmental Protection Authority, which is subject to particular conditions and restrictions.

Executive Decree No. 305, September 2002, published in Official Gazette No. 24634, 9 September 2002, introduces a national legislative measure. Its Article V states: "All substances that are banned or severely restricted in at least four States will also be restricted in our country". Carbofuran is substance No.142 of Annex I to this Executive Decree. Resolution DAL 015, 12 April 2010, published in the Official Gazette No. 26521 of 28 April 2010, bans Carbofuran active ingredient use in agriculture.
Remarks:
Currently, there are no inventories of this product. Import and use in agriculture is prohibited due to highly harmful effects on public health, and its polluting effect on the environment, as reported in multiple international studies.

Currently this pesticide has been withdrawn from registration in Trinidad and Tobagp and no further shipments are allowed. As such no import licecnses will be issued for the importation of this pesticide. All imports of Alachlor have been notified of these actions. This is as required under the Pesticides and Toxic Chemicals Act 1979 and Pesticides Import Licensing and Pesticides Registration Regulations 1987.

Türkiye Final decision No consent to import 12/06/2020
Legislative or administrative measures:
According to the Law on Veterinary Services, Plant Health, Food and Feed Law no. 5996 dated 11/06/2010 and the By-law On Licensing/Registration and Marketing of Plant Protection Products (Official Gazette no. 30235 dated 09.11.2017), marketing (including import) and use of unregistered plant protection products within the territory of the country are prohibited.
Carbofuran is not registered as plant protection product in the country. By the Ministry of Agriculture, production and import ofCarbofuran was banned in 01.01.2009 and its use was banned in 01.01.2011. Therefore the final decision of Turkey is no consent to import.

Viet Nam Final decision No consent to import 12/12/2021
Legislative or administrative measures:
All prohibited pesticides in Vietnam is regulated at Law on Plant Protection and Quarantine No 41/2013/QH13 dated 25 November2013; and Paragraph 3, Article 6, Circular No.21/2015/TT-BNNPTNT dated June 8, 2015 by the Ministry of Agriculture and Rural Development regulated on pesticides management shows that pesticides listed in Annex III of the Rotterdam Convention are not permitted to register.
Plant Protection Department only agreed to allow import in case of importing chemical standards for research purposes.
Remarks:
Carbofuran is withdrawn out of the list of plant protection products permitted to use in Vietnam at Circular No 03/2015/TT-BNNPTNT Jan 29, 2015 by the Minisry of Agriculture and Rural Development issued the list of pesticides permitted to use in Vietnam.
The pesticides containing the active ingredient Carbofuran were prohibited from being used in agriculture in Vietnam according to Circular No 03/ 2018/ TT-BNNPTNT dated Feb 09,2018 issued by the Minisry of Agriculture and Rural Development.
Zimbabwe Final decision No consent to import 12/12/2019
Legislative or administrative measures:
The Legislation regulating pesticides in Zimbabwe is the Fertilizers, Farm Feeds and Remedies (FFRFR) Act (Chapter 18:12) of 1996 and Pesticides Regulations (Statutory Instrument 144 of 2012). The import responses were done in accordance with Section 5 (d) of the FFFR Act which states that cancellation of registration may be done when the Registrar feels:
5 (d) that is the contrary to the public interest that a registered fertilizer, farm feed, remedy or sterilizing plant should remain registered; he may be cancel the registration thereof and shall thereupon notify the person who applied for the registration of such cancellation.
