Final decision is based primarily on the fact that Ethylene oxide is a highly hazardous chemical based on the WHO classification. It poses an unacceptably high risk to human health and the environment. The pesticides and Toxic Chemicals Control Board is committed to registering only lowest risk pesticides for use in the country unless viable alternatives are unavailable. Viable alternatives are available for this product.

Remarks:
Ethylene oxide was banned for use as a plant protection product by Regulation (BG) on import and export of certain dangerous substances, preparations and products (CM Decree N 129 of 01.07.2002, SG 66 of 09.07.2002, p. 7).

The measure is based on the absence of authorisation as an agricultural pesticide for this substance; such authorisation can be obtained from the Agricultural and Husbandry Service; without authorisation, it is not possible to import, manufacture, distribute, sell or use this pesticide in Chile.
To get the authorisation, it is necessary to comply with strict norms at the national level, indicating the procedures, evaluation and information necessary to get the authorisation.

Conditions for import:
The product is not registered for domestic sale to the Colombian Agricultural Institute (ICA), thus can't be imported, manufactured, formulated, distributed, commercialised or used in Colombia as Chemical Pesticide for Agricultural use. However, the only permitted use is as a sanitizer under the conditions laid down in Decree 1669 of 2002, "Article 8": Amended Decree 2676 of 2000, Article 15, which reads: "Use of Ethylene Oxide and Hexachlorophene. The manufacturers regulated by this Decree, shall remove in a period not exceeding 3 years, the use of Ethylene Oxide in mixtures with chlorofluorocarbons CFC and in mixtures with hidrochlorofluorocarbons HCFC compounds, as well as in non-automated systems". In any case must be ensured that the maximum occupational exposure allowed should not be exceed in any area within the Health System, as identified by the American Association of Industrial Hygienists ACGIH, for the Ethylene Oxide.

Conditions for import:
For plant protection products
In the European Union, it is prohibited to place on the market (including import) or use plant protection products containing ethylene oxide, since that active substance has not been approved under Regulation (EC) No 1107/2009.
For biocidal products
Ethylene oxide is under review in accordance with Regulation (EU) No 528/2012 for uses covered by product type 2 and therefore the making available on the market and use of biocidal products containing ethylene oxide is only allowed for uses covered by product-type 2, which are disinfectants and algaecides not intended for direct application to humans or animals as defined in Annex V to that Regulation.
Responses of individual Member States of the European Union for ethylene oxide in biocidal products falling within product-type 2 are as follows: Member States that consent to import, subject to any national restrictions that may apply: Belgium, Denmark, France, Germany, Estonia, Ireland, Latvia, Luxembourg, Sweden, UK.
Member States that consent to import, subject to prior written authorisation: Austria, Bulgaria, Croatia, Finland, Hungary, Italy, Lithuania, Netherlands, Poland, Portugal, Slovenia.
Member States that consent to import only for sterilisation of surgical tools in accordance with Council Directive 93/42/EC concerning medical devices (OJ L 169, 12.7.1993, p.1), subject toprior written authorisation: Cyprus, Greece, Slovakia, Spain, Romania.
Member States that do not consent to import: Czech Republic, Malta.

Plant protection products
Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC (OJ L 309, 24.11.2009, p. 1) prohibits to place on the market or use plant protection products containing ethylene oxide.
Biocidal products
Ethylene oxide has not been approved as an active substance under Regulation (ELI) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (OJ L 167, 27.6.2012, p.1). It is, however, under review and listed in Annex II to Commission Delegated Regulation (EU) No 1062/2014 of 4 August 2014 on the work programme for the systematic examination of all existing active substances contained in biocidal products referred to in Regulation (EU) No 528/2012 of the European Parliament and of the Council (OJ L 294, 10.10.2014, p.1). Consequently, in the European Union, the making available on the market and use of biocidal products containing ethylene oxide is only allowed for uses covered by product-type 2 (disinfectants and algaecides not intended for direct application to humans or animals) as defined in Annex V to Regulation (EU) No 528/2012.

Ministerial Order No. 396 /2002 on the banning of the use of plant protection products containing certain active substances on Romania's territory transposed partially the Directive 79/117/EEC of 21 December 1978 banning the placing on the market and use of plant protection products containing certain active substances, laid down in the Annex 1 at the Ministerial Order No.396/2002, excepting for research or laboratory analyses uses and export.
In the emergency situations which can not be solved through other means, the Interministerial Commission for the certification of plant protection products may authorize for a period of maximum 120 days the placing on the market or the use of the plant protection products containing one or several substances mentioned in the annex.
*Romanian final regulatory action bans all formulations in plant protection products
of the Ethylene oxide (Oxirane).
Remarks:
The manufacturing and the import of plant protection products containing one or several of the active substances laid down in annex and which are certificated for their use in Romania are banned, the existing stocks to be consumed within 12 months from the entrance into force of the present order. This means, starting with 18 January 2003 as it is foreseen in the Ministerial order No.396/2002.

Health Ministry is in the process of searching an alternative and once getting the alternative the pesticide Ethylene oxide will be banned.

Palestinian Environmental Law No7 for the year 1999.
Article (14) the Ministry, in coordination with the specialized agencies shall designate the environmental conditions for the import, distribution, manufacturing, use, and store of pesticides, substances, and agro-chemicals fertilizers, which may pose hazards to the environment.
Article (15), the Ministry, in coordination with the specialized agencies shall set instructions and standards specified for agrichemicals, that are allowed to be imported, manufactured and distributed in Palestine, and shall ensure observance of it.

By-law on On Licensing/Registration and Marketing of Plant Protection Products was published by the Ministry of Agriculture on 9 November 2017 in Official Gazette No. 30235.
The purpose of this By-law is protection of plants or plant products from all kinds of harmful organisms or preventing the effects of such organisms and is to determine the principles and procedures related to the licensing and placing on the market of plant protection products in commercial form to be used against harmful organisms in the environments where plants and plant products are grown and maintained.
According to the By-law marketing (including import) and use of unregistered plant protection products within the territory of the country are prohibited. Ethylene oxide is not registered as plant protection product in the country.
For Biocidal Products:
By-law on Biocidal Products was published by the Ministry of Health on 31 December 2009 in Official Gazette No. 27449 (4th Bis.).
The purpose of this By-law is to determine the procedures and principles related to the licensing, registration, marketing, packaging, labeling, classification, inspection and other issues related to biocidal products with the production and importation of biocidal products in order to evaluate the risks related to human, animal and environmental health before they are placed on the market.
Ethylene oxide is under review in accordance with this By-law for uses covered by product type 2 and therefore the making available on the market and use of biocidal products containing ethylene oxide is only allowed for uses covered by product-type 2, which are disinfectants and algaecides not intended for direct application to humans or animals as defined in Annex V to that By-law.
