Burundi Final decision No consent to import 12/06/2014
Legislative or administrative measures:
It is prohibited to import and use Endosulfan, in all its forms in Burundi under Ministerial order n 710/1464 of 16 October 2013.
The reasons underlying its ban are : i) high acute oral toxicity; ii) operators' exposure higher than the acceptable level, even for operators using standard personal protective equipment; iii) unclear degradation pathway since unknown metabolites have been observed during studies conducted in the soil and in water/sediment systems; iv) volatile compound which main metabolite is persistent and traces of which are found in regions where it had not been used, according to surveillance data.
Endosulfan is listed in the register of banned pesticides under n 2013-01-P-001.
Remarks:
Until its ban, endosulfan 50 WP had been used in bean maggot control, Ophyomia spp. Alternative products are available, in particular Deltamethrin 25 EC, Chlorpyriphos-ethyl 48 EC.

Colombia Final decision No consent to import 12/06/2012
Legislative or administrative measures:
Health Ministry Resolution 1669, Article I, 27th May 1997, issued on May 27th 1997, prohibiting import, manufacturing, marketing and use of products formulated with mixtures of Endosulfan and other active ingredients. This ban was reinforced by the State Council Decision N 11001-03-24-000-1999-5483-01 (5483), Section One, of March 23, 2001. During the Fifth Meeting of the Parties (COP-5) to the Stockholm Convention, on Persistent Organic Pollutants, held from 25th to 29th of April 2001 in Geneva, Switzerland, the Representatives of 127 governments, agreed to include Endosulfan, technical grade and its isomers in the Annex A of the Convention, i.e. in the list of chemicals which production and use must be eliminated. Specific exemptions to the amendment to Annex A that will enter into force in one year were also defined. Likewise, the Fifth Conference of the Parties (COP-5) to the Rotterdam Convention, on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, held in Geneva, Switzerland, from 20th to 24th June 2011, unanimously agreed to include Alachlor, Aldicarb and Endosulfan in the list of pesticides in Annex III of the Convention, included them in the list of chemicals subject to the PIC Procedure as well. In line with the Decisions RC-573, RC-5/4 and RC-5/5, entered into force on 24 October 2011.
Remarks:
Decree No. 2820 of 2010, published in the Official Journal No. 47792 of 5th August 2010, Title II, on the exigibility of Environmental Licenses, in Article 8, established that the Ministry of Environment, Housing and Territorial Development, may permanently grant or deny such environmental license for the activities ()11. The import and/or manufacturing of those substances, materials or products subject to controls pursuant to treaties, conventions and international protocols, of environmental nature, except in cases where these rules point out a special authorisation for such purpose. Since they are LMO's (Living Modified Organisms), for which only the procedure established in Act 740 of 2002 and its regulatory decrees or rules that modify, replace or repeal it will be applied in their evaluation and decision.
Also, in line with the Andean Decision of Nations No.436; Andean Standard for the Registration and Control of Chemical Pesticides for Agricultural use, published in Official Journal (Year XIV, No.347, in Lima, Peru, on 17th June 1988, on the Cartagena Agreement), and the Resolution of the Colombian Institute for Agriculture and Farming (ICA) No.03759 of 16th December 2003, to enact provisions for the Registration and Control of Chemical Pesticides for Agricultural use, pesticides must be registered to be used and marketed in the country.
IMPORTANT NOTE: According to information from the Technical Department of Agricultural Inputs Safety of ICA, the product is not registered for domestic sales in the Colombian Institute for Agriculture and Farming (ICA), and consequently it can't be imported, manufactured, formulated, distributed, marketed or used in Colombia as a chemical pesticide in agriculture.

Decree No. 38677-MAG-S-MINAE-MTSS established:
Article 1 - The purpose of this Decree is to prohibit the registration, import, export,
manufacturing, formulation, storage, distribution, transportation, repackaging, handling, sale, mixing and use of the technical grade active ingredient and synthetic pesticides formulations containing the active ingredient Aldicarb and revoking Executive Decree No. 34147-S-MAG-TSS-MINAE.
Article 2 - The use of Endosulfan is prohibited in all crops; except for the cultivation of coffee, in which its use is authorized for a period of 24 months to control the coffee borer, Hypothenemus hampei, after which, use will be totally prohibited.
Article 3 - Formulated synthetic pesticides containing endosulfan for use in the
coffee cultivation, they may only be distributed and sold to the user under a professional prescription issued and signed by a professional in Agricultural Sciences member to the Agricultural Engineers College.
Article 4 - Marketing of formulated synthetic pesticides containing
Endosulfan, must have attached label and pamphlet to the container or package, which must indicate at the top the following sentence: "RESTRICTED SALE UNDER
PROFESSIONAL RECIPE FOR EXCLUSIVE USE IN COFFEE CROPS", and in
Recommendations for use of the pamphlet should indicate: use only in coffee crops.
Article 5 - Legal and Natural persons that register, import, export, manufacture, formulate, store, distribute, transport, repackage, manipulate, sell, mix and use formulated synthetic pesticides, technical grade active ingredient containing Endosulfan, issued under professional prescription, will keep a log with the record of any movement of the product that it registered, imported, exported, manufactured, formulated, stored, distributed, transported, repackaged, handled, sold, mixed and used, which will be verified by the Control Unit and by the Regional Operational Units of the State Phytosanitary Service of the Ministry of Agriculture and Livestock. The log must indicate the brand of the product, the formulation date or entry into the country, the name of the natural or legal persons to whom the product was sold, the quantity, presentation, date of operation, prescription number, invoice No., name of the professional and number of collegiate who issued the recipe, use of the product and inventory balance.
Article 6- People performing tasks of handling and use of active ingredients technical grade and synthetic pesticides formulated containing Endosulfan, must comply with articles 8, 9, 10, 11, 12 and 13 of Executive Decree No. 38371-S-MTSS, of 14 February 2014, "Regulations on provisions for occupationally exposed people to pesticides". In addition, staff must be trained and use appropriate safety prevention measures and personal protection prescribed for this pesticide.
Article 7 - The Ministries of Agriculture and Livestock, Health, Environment and Energy, and Labor and Social Security in compliance with their Laws and competences, will ensure the compliance with these provisions.
Article 8-Failure to comply with the provisions established in this Decree, will result in the application of the sanctions indicated in the General Health Law, the Organic Law of the
Environment, the Phytosanitary Protection Law and the Labor Code, without prejudice to the rest of
sanctions established in the national legislation.
Article 9- Revokes Executive Decree No. 34782-S-MAG-MTSS-MINAET, "Regulation for
the use and control of raw material or formulated product containing the agricultural pesticide
Endosulfan ", published in the Official Gazette La Gaceta N 195, 9 October 2008.Transitory I.- Legal or natural persons that register, import, export, manufacture,
formulate, store, distribute, transport, repackage, handle, sell, mix and use formulated synthetic pesticides containing Endosulfan, not having authorized use for the cultivation of coffee, will have a non-extendable period of six months, counted
as of the publication of this Decree in the Official Gazette La Gaceta to exhaust its
stocks in the national market. After this period, the Ministry of Agriculture and Livestock through the State Phytosanitary Service, will proceed to cancel all registrations.
Transitory II.-Legal or natural persons that register, import, export, manufacture,
formulate, store, distribute, transport, repackage, handle, sell, mix and use technical grade active ingredient or formulated synthetic pesticide, containing
Endosulfan and authorized for use in coffee crops, will have a non-extendable term of
six months, counted from the publication of this Decree, to comply with the provisions
in articles 3, 4, and 5.
Transitory III.-In a non-extendable period of twenty-four months, counted from the
publication of this Decree in the Official Gazette La Gaceta, the Ministry of Agriculture and Livestock through the State Phytosanitary Service will proceed to the cancellation of all records of pesticides, technical grade active ingredient, and formulated synthetic pesticide, the latter with authorization for use in coffee, containing the ingredient active Endosulfan.
In a period of six months prior to the cancellation of the records, the natural or legal persons that register, import, export, manufacture, formulate, store, distribute,
transport, repackage, handle, sell, mix and use pesticides containing Endosulfan, authorized for use in coffee crops, must exhaust their stocks. This regulation is available at:

Remarks:
The Resolution establishes a period of three (3) months from issuance date (March 13, 2014), for selling all pesticides stockpiles containing ENDOSULFAN including imported items which must be dispatched to country of origen, prior to resolution date.
The Directorate of Plant Protection, Ministry of Agriculture is authorized to make a survey of stockpiles of this pesticide, and once accomplished, registers of all pesticides containing the ENDOSULFAN molecule will be canceled.
Once the deadline is met, the Ministry will proceed on confiscation of products containing ENDOSULFAN.

It is prohibited to place on the market or use plant protection products containing endosulfan, since this active substance is not approved under Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC (OJ L 309, 24.11.2009, p. 1), pursuant to Commission Decision 2005/864/EC of 2 December 2005 concerning the non-inclusion of endosulfan in Annex I to Council Directive 91/414/EEC and the withdrawal of authorisations for plant protection products containing this active substance (OJ L 317, 3.12.2005, p. 25).
Furthermore, it is prohibited to place on the market or use biocidal products containing endosulfan since this active substance is not authorized under Directive 98/8/EC of the European Parliament and of the Council concerning the placing of biocidal products on the market (OJ L 123, 24.04.1998, p. 1), pursuant to Commission Regulation (EC) No 1451/2007 of 4 December 2007 on the second phase of the 10-year work programme referred to in Article 16(2) of Directive 98/8/EC of the European Parliament and of the Council concerning the placing of biocidal products on the market (OJ L 325, 11.12.2007, p. 3).

In accordance with Regulation (EC) No 1272/2008, which implements the UN Globally Harmonised System of Classification and Labelling of Chemicals in the EU, endosulfan is classified as:

Legislative or administrative measures:
Pursuant to Pest Control Products Act CAP 346 and the Pest Control Products (Registration) Regulations of 1984 (Rev.2012) on safeguarding human health and environment, the Board of Management of the Pest Control Products Board banned the use of Endosulfan in 2011. The PCP Act CAP 346 and the Pest Control Products (Registration) Regulations of 1984 (Rev.2012) empowers the Board to refuse approval of use of a pest control product if the use of the pest control product would lead to an unacceptable risk to public health, plants, animals, or the environment. The Board may also revoke any existing registration if new information becomes available that renders the pest control product unsafe or dangerous.
The final decision was informed by the decision guidance document (DGD) on Endosulfan that was communicated to designated national authorities on 24th October 2011 in accordance with Articles 7 and 10 of the Rotterdam Convention, and by supporting information from notifying countries of European Community, Burkina Faso, Capo Verde, Gambia, Guinea-Bissau, Mali, Mauritania, Niger and Senegal.
From the information sources, it was concluded that the use of endosulfan presents an unacceptable risk to human health and the environment. In human health consideration, endosulfan was observed to present unacceptable occupational risk of harm to operators from common application exposure scenarios. Even after consideration of maximum feasible engineering controls such as spraying with tractor mounted hydraulic nozzles for high crops and use of standard personal protective clothing (PPE) clothing, the exposure was still potentially greater that the acceptable operator exposure level (AOEL).
Endosulfan also poses a potentially high risk to non-target organisms. Due to its volatile property, its main metabolite being persistent, and it being found in monitoring results of regions where the substance was not used, Endosulfan's potential for long range transport and for bioaccumulation were objects of concern. The Toxicity Exposure Ratios (TER) indicated a potential long-term risk to fish, even assuming large buffer zones. There were also potentially high risks to terrestrial birds and mammals, honeybees and earthworms.

Endosulfan is not included in the State Register of pesticides and agrochemicals permitted for use in the Kyrgyz Republic for years 2011-2019, approved by the Government of the Kyrgyz Republic, November 4, 2011- N 704.

Endosulfan is not on the list of active substances to be examined under the EU review programme (Annex II of the COMMISSION REGULATION (EC) No 1451/2007 on the second phase of the 10-year work programme referred to in Article 16(2) of Directive 98/8/EC of the European Parliament and of the Council concerning the placing of biocidal products on the market). The Swiss Ordinance on Biocide Products (entered into force in May 2005) adopts the same biocide active ingredients as the EU. Endosulfan is not authorized in biocide preparations.

New Zealand Final decision No consent to import 12/12/2012
Legislative or administrative measures:
On 15 December 2008, the Environmental Risk Management authority of New Zealand, under the Hazardous Substances and New Organisms Act (HSNO), revoked all approvals for the import, manufacture or use of endosulfan and endosulfan products. The ban (including on use) took effect from 16 January 2009 and all existing stocks had to be disposed of by 16 January 2010.
The revocation of approvals followed a reassessment carried out under the provisions of section 63 of HSNO, which included a determination that the environmental and human health risks associated with the use of the products outweighed the benefits obtained from its use.
In August 2011, HSNO was amended to expressly prohibit the import of endosulfan.

By Executive Decree No. 305 of September 4th, 2002, of the Ministry of Health, published in the Official Gazette No. 24634 of September 9th, 2002, it was established a national legislative action. In its third article it states: " The substances or products described in Annex 1, are considered controlled hazardous substances and materials; and their residues are hazardous wastes". Endosulfan is the substance No. 336 of Annex 1 to this Decree.
Endosulfan active ingredient, in all its forms, is of restricted use in agriculture by Resolution No.32, of 8 June 2006, of the Ministry of Agriculture, and published in the Official Gazette No. 25584 of 10 Julio 2006.
Remarks:
According to Resolution No.32, of 8 June 2006, the use of Endosulfan active ingredient has been restricted given the high toxicity to aquatic fauna. This restriction includes the following: 1) Do not allow aerial applications; 2) Do not allow applications in rice farming areas or other applications that may contaminate water sources by improper use.

Palestinian Environmental Law No7 for the year 1999.
Article (14) the Ministry, in coordination with the specialized agencies shall designate the environmental conditions for the import, distribution, manufacturing, use, and store of pesticides, substances, and agro-chemicals fertilizers, which may pose hazards to the environment.
Article (15), the Ministry, in coordination with the specialized agencies shall set instructions and standards specified for agrichemicals, that are allowed to be imported, manufactured and distributed in Palestine, and shall ensure observance of it.

5. The National Technical Committee for the Management of Chemicals and Hazardous Wastes reviewed the chemicals have been listed in Annex III of the Rotterdam Convention and Stockholm convention and adopted import responses.

Legislative or administrative measures:
According to the Law on Veterinary Services, Plant Health, Food and Feed Law no. 5996 dated 11/06/2010 and the By-law On Licensing/Registration and Marketing of Plant Protection Products (Official Gazette no. 30235 dated 09.11.2017), marketing (including import) and use of unregistered plant protection products within the territory of the country are prohibited.
Endosulfan is not registered as plant protection product in the country. By the Ministry of Agriculture, production and import of Endosulfan were banned in 01.01.2009 and its use was banned in 01.01.2011. And also manufacturing/production, marketing (including import) and use of Endosulfan (as substance, in the mixture and as a constituent of articles) were banned according to the By-law on Persistent Organic Pollutants (Official Gazette no 30595 dated 14.11.2018) by the Ministry of Environment and Urbanization.Therefore the final decision of Turkey is no consent to import.
