Conditions for import:
1. The import, production, placing on the market and use of tetrabromodiphenyl ether and pentabromodiphenyl ether shall be allowed for substances, mixtures, articles or as constituents of flame-retarded parts of articles which contain tetrabromodiphenyl ether or pentabromodiphenyl ether as impurity in concentrations equal to or below 10 mg/kg (0,001 % by weight).
2. The import, production, placing on the market and use shall be allowed for mixtures and articles containing concentrations below 0,1 % of tetrabromodiphenyl ether or pentabromodiphenyl ether by weight when produced partially or fully from recycled materials or materials from waste prepared for re-use.

1. The import, production, placing on the market and use of these substances, mixtures and articles containing these substances is prohibited, so as their export.
2. By way of derogation of paragraph 1, import, production, placing on the market and use of tetrabromodiphenyl ether and pentabromodiphenyl ether shall be allowed for substances, mixtures, articles or as constituents of flame-retarded parts of articles which contain tetrabromodiphenyl ether or pentabromodiphenyl ether as impurity in concentrations equal to or below 10 mg/kg (0,001 % by weight).
3. The import, production, placing on the market and use shall be allowed for mixtures and articles containing concentrations below 0,1% of tetrabromodiphenyl ether or pentabromodiphenyl ether by weight when produced partially or fully from recycled materials or materials from waste prepared for re-use. Restrictions referred to in paragraph 2 of this point shall not apply to electrical and electronic equipment, which is regulated by other legislation.
4. Use of articles already in use before entry into force of this rulebook/decision, and which contain tetrabromodiphenyl ether or pentabromodiphenyl ether shall be allowed.

The above named regulations prohibit the manufacture, use, sale, offer for sale and import of PBDEs and all products that contain PBDEs with a limited number of exemptions, see "Other remarks" section.
Remarks:
The Regulations do not apply to any toxic substance that is:
a) contained in a hazardous waste, hazardous recyclable material or non-hazardous waste to which Division 8 of Part 7 of CEPA applies;
b) contained in a pest control product as defined in subsection 2(1) of the Pest Control Products Act;
c) present as a contaminant in a chemical feedstock that is used in a process from which there are no releases of the toxic substance and on the condition that the toxic substance is destroyed or completely converted in that process to a substance that is not a toxic substance set out in either Schedule 1 or 2 of the regulations; or
d) to be used in a laboratory for analysis, in scientific research or as a laboratory analytical standard.
The Regulations do not prohibit:
. The import, manufacture, use, sale and offer for sale of PBDEs or a product containing them, if PBDEs are incidentally present.
. The import, manufacture, use, sale or offer for sale of a product that is a manufactured item that is formed into a specific physical shape or design during its manufacture and that has, for its final use, a function or functions dependent in whole or in part on its shape or design, if PBDEs are present in that product.

The management of commercial pentabromodiphenyl ether is covered by Act 1196 of 2008, taking into account that the country is a Party to the Stockholm Convention, which was approved in Colombia through Act 1196 of 2008. Its instrument of ratification was deposited in October 22 of the same year. Therefore the Convention entered into force for the country on January 20, 2009. It was declared enforceable by Constitutional Court Decision C-944/08.
There are no specific import records. However, in 2009, the use of pentabromodiphenyl ether was listed in Annex A (Elimination) as POP substance under the Stockholm Convention.

Pursuant to Regulation (EU) 2019/1021, the placing on the market and use of commercial pentabromodiphenyl ether is only allowed in accordance with Directive 2011/65/EU, where the following provisions apply:
The import of commercial pentabromodiphenyl ether is only allowed for placing on the market and use in cables or spare parts for the repair, the reuse, the updating of functionalities or upgrading of capacity of the following:
(a) electrical and electronic equipment (EEE) placed on the market before 1 July 2006;
(b) medical devices placed on the market before 22 July 2014;
(c) in vitro diagnostic medical devices placed on the market before 22 July 2016;
(d) monitoring and control instruments placed on the market before 22 July 2014;
(e) industrial monitoring and control instruments placed on the market before 22 July 2017;
(f) all other EEE that was outside the scope of Directive 2002/95/EC and which is placed on the market before 22 July 2019;
(g) EEE which benefited from an exemption and which was placed on the market before that exemption expired as far as that specific exemption is concerned.
Spare parts are defined as a separate part of an EEE that can replace a part of an EEE. The EEE cannot function as intended without that part of the EEE. The functionality of EEE is restored or is upgraded when the part is replaced by a spare part.

In the Union, the manufacturing, placing on the market and use of tetrabromodiphenyl ether and pentabromodiphenyl ether are, subject to certain exemptions, prohibited pursuant to Regulation (EU) 2019/1021 of the European Parliament and of the Council of 20 June 2019 on persistent organic pollutants (OJ L 169, 25.06.2019, p. 45).

Commercial pentabromodiphenyl ether (including Tetrabromodiphenyl ether and Pentabromodiphenyl ether) is not entered in the list of registered chemicals in Montenegro, and is not on the list of active substances permitted for use in the plant protection plan for 2018.
Some uses of this substance are restricted under Decree on prohibited and permitted methods of use, manufacture, and placing on the market of chemicals that present unacceptable risk to human health and the environment which fully transposed Annex XVII of REACH regulation.

Legislative or administrative measures:
Tetrabromodiphenyl ether and Pentabromodiphenyl ether are listed as a persistent organic pollutant (POP) in Schedule 2A of the Hazardous Substances and New Organisms Act 1996 (HSNO Act). Under section 25A of the HSNO Act it is prohibited to be imported or manufactured or used. This includes manufactured articles containing this substance. Exceptions apply to the import or manufacture of small quantities for use as an analytical standard or for research and development in a laboratory, or the import for environmentally sound disposal, or where it is present as an unintentional trace contaminant in products and articles. An 'articles in use' notification has been made to the Secretariat of the Stockholm Convention for tetrabromodiphenyl ether and pentabromodiphenyl ether (commercial pentabromodiphenyl ether) used as a flame retardant in a wide range of consumer products including textile and foam-based products such as mattresses, furniture and carpet backing. Its main use was in polyurethane foam.
Remarks:
Commercial pentabromodiphenyl ether (including tetrabromodiphenyl ether and pentabromodiphenyl ether) is also listed in Schedule 1: Stockholm chemicals and Schedule 2: Rotterdam chemicals of the Imports and Exports (Restrictions) Prohibition Order (No 2) 2004. It may not be exported unless a permit is issued by the Environmental Protection Authority, which is subject to particular conditions and restrictions.

In Norway pentaBDE is regulated according to Regulation (EC) no 850/2004 in Chapter 4 of the "Regulations relating to restrictions on the manufacture, import, export, sale and use of chemicals and other products hazardous to health and the environment (Product Regulations)" by the Ministry of the Environment. Act no 922 of 1 June 2004.
Production, placing on the market and use of tetrabromodiphenyl ether and pentabromodiphenyl ether, whether on their own, in preparations or as constituents of articles, is prohibited by Regulation (EC) No 850/2004 and amending regulation ((EU) No 757/2010) with a maximum concentration limit of 0,1 % by weight. The prohibition does not apply when these substances (a) are used for laboratory-scale research or as a reference standard; (b) occur as an unintentional trace contaminant in substances, preparations, articles or as constituents of the flame-retarded parts of articles at concentrations equal to or below 10 mglkg (0,001 % by weight).
