Notifications of Final Regulatory Actions

Introduction
            In this section you will find information on all notifications of final regulatory actions for all chemicals submitted to the Secretariat after September 1998 and found to be complete against Annex I of the Convention. Summaries of notifications for all chemicals may be found in the Rotterdam Convention database.
            You will find Appendix V of the PIC Circular which contains information on the subset of notifications of final regulatory actions for chemicals that are not listed in Annex III of the Convention, including a reference to the PIC Circular in which the summary of the notification was published. 
            You will also find information on notifications concerning those chemicals which have been already considered by the Chemical Review Committee. 
            Finally, you will also find information on the process for the submission of notifications as well as copies of the relevant forms and instructions developed to facilitate this process.  
Notifications of final regulatory actions to ban or severely restrict a chemical
             Article 5 of the Convention sets out the obligations of Parties with respect to notifying the Secretariat of their final regulatory actions to ban or severely restrict a chemical for health or environmental reasons. If a Party takes a final regulatory action to ban or severely restrict a chemical for health or environment reasons, it shares the information with all Parties by notifying the action to the Secretariat. Upon receipt of a notification of final regulatory action the Secretariat must verify whether it meets the information requirements of Annex I of the Convention. If the notification is found to be complete a summary is prepared and published in the PIC Circular. The summary briefly describes the scope of the action and the reasons, including information on hazards and risks of the chemical to human health or environment and the expected effect of the regulatory action. 
            Summaries of the all complete notifications submitted to the Secretariat after September 1998 may be found in the Rotterdam Convention database searching either by chemical name or by country. 
            Parties in preparing the submission of notifications of final regulatory actions may wish to consider giving priority to the following subsets of chemicals for which notifications have already been submitted to the Secretariat. 
  • Appendix V of the PIC Circular  contains the subset of those notifications for chemicals that are not listed in Annex III of the Convention. Appendix V consists in a tabular summary of the notifications received for these chemicals including a reference to the PIC Circular in which the summary of the notification was published.
  • A further subset of notifications concerns those chemicals which have been considered by the Chemical Review Committee. Where the Chemical Review Committee has determined that only one of the notifications of final regulatory actions in support of a candidate chemical meets the criteria of Annex II of the Convention a rationale is prepared which explains how the criteria have been met. This rationale becomes part of the Report of the meeting of the Chemical Review Committee. The information available for this subset of chemicals includes: notifications of final regulatory actions, supporting documentation and the rationales.  
Notification of final regulatory actions form and instructions
            To facilitate the implementation of Article 5 of the Convention, the Secretariat has developed a “notification of final regulatory action form” and associated instructions to facilitate the preparation and submission of notifications by Parties. In order to accommodate the various needs and working conditions of the end-users the forms are available in three formats.
